Cactian collects and processes data in the following ways:
- User Data from Third-Party Platforms: Cactian facilitates the retrieval of user data from third-party services, including Google and YouTube, strictly with user consent. This may include data such as liked videos, playlists, and subscriptions. This data is temporarily processed on behalf of the Customer and made available to them. Cactian does not determine the purposes or means of data processing and does not store personal data beyond what is necessary for processing.
- Website Data: When users voluntarily submit their email address on our website, we collect this information to provide updates and communications related to our services.
- Technical & Usage Data: We may collect anonymized analytics data to improve our website and services, such as traffic patterns and interaction metrics.
3. Purpose of Data Processing
Cactian processes data solely on behalf of and under the instructions of the Customer (the data controller). The purposes for which the data is used are determined by the Customer, and typically include enhancing their services to end-users (e.g. providing recommendations similar to what the user liked in other platforms), subject to valid user consent. Such use must always comply with the policies of the respective data providers (e.g., Google and YouTube) and applicable data protection laws.
We may also use data collected directly from our website (e.g. email addresses) for the purpose of responding to inquiries or sending updates, where permitted.4. Data Retention
- User data from third-party platforms is not retained beyond the necessary processing period.
- Email addresses collected via the website are stored until the user unsubscribes or requests deletion.
- Anonymized analytics data is retained for service improvement purposes.

- Cactian processes user data from third-party platforms, including Google and YouTube, strictly on behalf of the Customer and in accordance with user consent.

- We do not sell, rent, or disclose Google or YouTube user data to third parties. We process this data strictly on behalf of the Customer (the data controller), and only share it with that Customer in accordance with the user’s explicit consent. We do not use or share Google user data beyond what is necessary to provide or improve our service, as permitted under the Google API Services User Data Policy.
- We do not use collected data for any purpose other than those explicitly stated.
- Cactian does not train AI models with user data.

Cactian integrates with third-party platforms, and Customers must comply with their respective API terms and policies.
Cactian uses cloud infrastructure to ensure security, scalability, and availability of the services.Cactian is not responsible for:
- Service disruptions or changes in policies from third-party API providers.
- The availability, functionality, or security of third-party platforms.
4. User Consent & Customer Responsibilities4.1. User Consent Collection
Cactian facilitates user consent collection within its UI and shared via API. The Customer is responsible for ensuring compliance with data protection laws (e.g., GDPR, CCPA) and securely storing consent records.
4.2. Privacy Policy Requirements
The Customer must provide a compliant privacy policy that clearly informs users:
- What data will be accessed and how it will be used.
- How users can withdraw consent or request deletion.
Cactian will display this privacy policy to users before requesting access to their data.4.3. No Unauthorized Use
Customers may only use data obtained through Cactian for lawful purposes and in compliance with applicable regulations. Misuse may result in immediate account termination.
5. Prohibited Uses
The Customer agrees not to use Cactian for:
- Illegal or unethical activities, including any violations of data privacy regulations.
- Processing data related to adult content, gambling, or other high-risk industries.
- Re-identification of anonymized users or tracking users beyond the agreed scope.
Failure to comply with these restrictions may result in termination of services and potential legal action.6. Security & Compliance6.1. Data Security

- It does not use data to train AI models.
The Customer, as the data controller, is responsible for compliance with GDPR, CCPA, and other applicable data protection laws.
If a user exercises their right to erasure or withdraws consent, the Customer must ensure that the data is deleted from their systems.
7. Data Retention & Deletion
Cactian does not retain user data beyond the necessary processing period. Customers are responsible for:
- Defining their own data retention policies in compliance with applicable laws.
- Ensuring that users have a clear process to request deletion of their data.
Upon termination of the Customer’s account, all associated data is permanently deleted, unless otherwise required by law.8. Limitation of Liability
No Warranty. Cactian provides its services "as is" and makes no guarantees about availability or performance.
Limited Liability. Cactian is not liable for direct, indirect, incidental, or consequential damages resulting from:
- The use or inability to use the Services.
- Data loss, business interruption, or unauthorized access.
- Third-party API failures or policy changes.
The Customer agrees to indemnify Cactian against any claims, losses, or damages resulting from their misuse of the Services.9. Service Availability & Termination9.1. Service Availability
Cactian operates using cloud services and strives for high availability. However, downtime may occur due to maintenance, third-party API limitations, or security incidents.
9.2. Account Termination
Cactian reserves the right to suspend or terminate a Customer’s account if:
- The Customer violates these Terms.
- There is evidence of unauthorized or unethical use.
Customers may terminate their account at any time. Upon termination, all associated data will be deleted as per the Data Retention & Deletion policy.10. Dispute Resolution
Any disputes arising from these Terms shall be resolved under the jurisdiction of Madrid, Spain.
Before pursuing litigation, both parties agree to first attempt resolution through mediation. If mediation fails, disputes shall be resolved in Spanish courts, unless otherwise agreed.11. Modifications to These Terms
Cactian reserves the right to update these Terms at any time. Customers will be notified of significant changes at least 30 days in advance before the new Terms take effect.
